Refund Policy

This Refund Policy constitutes a legally binding agreement. By completing your purchase, you acknowledge that you have read, understood, and agree to be bound by these terms. All sales are final unless you qualify for the limited exception described in Section 3.

This Refund Policy applies to all purchases of Cortana products and services ("Services") provided by Visionary Creations Inc. ("Cortana," "we," "us," or "our"), including but not limited to: Ad Tracking, iMessage subscriptions, phone calling, AI calling agents, AI usage fees, and any other current or future products, features, or usage-based charges. By purchasing any of our Services, you agree to be bound by this policy in its entirety.

1. Final Sale Policy

All Sales Are Final

ALL PURCHASES OF CORTANA PRODUCTS AND SERVICES ARE FINAL AND NON-REFUNDABLE, except as expressly provided in Section 3 of this policy (which applies only to Ad Tracking 3-Month Prepay plans).

By completing your purchase, you acknowledge and agree that:

  • Your purchase constitutes a final sale
  • You are making a final purchase with no expectation of refund
  • You have reviewed our Services and understand what you are purchasing
  • You waive any right to a refund except as explicitly stated in this policy

1.1 Products and Services Covered

This final sale policy applies to all Cortana products, services, subscriptions, and usage-based charges, including but not limited to:

  • Ad Tracking - Monthly subscriptions and usage fees
  • iMessage - Subscriptions and messaging usage
  • Phone Calling - Subscriptions and per-minute usage
  • AI Calling Agents - Subscriptions and usage fees
  • AI Usage - Any AI-powered features and associated usage charges
  • Any other current or future products, features, or services offered by Cortana

If a product or service is not explicitly listed above, it is still subject to this final sale policy. The absence of a specific product from this list does not create an exception or entitle you to a refund.

2. Payment Authorization and Chargeback Waiver

Payment Authorization Agreement

By completing your purchase, you enter into a binding payment authorization agreement with Cortana.

2.1 Credit Card Authorization

By providing your payment information and completing a purchase, you expressly authorize Visionary Creations Inc. ("Cortana") to:

  • Charge your credit card, debit card, or other payment method for the full purchase amount
  • Process recurring charges for subscription services as agreed at the time of purchase
  • Charge your payment method for any usage-based fees incurred during your subscription period
  • Retain your payment information on file for the duration of your subscription

2.2 Waiver of Chargeback Rights

BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY AND VOLUNTARILY WAIVE YOUR RIGHT TO INITIATE A CHARGEBACK, DISPUTE, OR PAYMENT REVERSAL with your credit card company, bank, or payment processor for any charges related to your Cortana subscription, except in cases of:

  • Unauthorized fraudulent use of your payment method by a third party
  • Technical errors resulting in duplicate charges (which we will promptly correct upon notification)

You acknowledge that this waiver is a material term of your purchase agreement and that Cortana has relied upon this waiver in providing you access to our Services.

If you have a billing concern or dispute, you agree to contact Cortana directly at hello@usecortana.ai before taking any other action.

3. Limited Refund Exception: Ad Tracking 3-Month Prepay Only

This Exception Applies ONLY to Ad Tracking 3-Month Prepay Plans

Customers who purchase a 3-month prepaid Ad Tracking plan specifically may be eligible for a full refund after completing our full onboarding and support process, subject to the strict conditions outlined below. This exception does NOT apply to any other Cortana product, service, subscription, or usage charge.

Important Clarification

This refund exception is exclusively for Ad Tracking 3-Month Prepay purchases. It does NOT apply to: iMessage, phone calling, AI calling agents, AI usage, monthly Ad Tracking subscriptions, or any other Cortana product or service. All other purchases remain final sale with no refund option.

This limited refund exception exists because we are confident in our Ad Tracking product and want to give prepay customers the opportunity to experience our full onboarding and support process. However, eligibility requires your active participation.

3.1 Eligibility Conditions

To be eligible for a refund under this exception, you must complete ALL of the following requirements:

Mandatory Requirements:

  1. Complete the Initial Onboarding Call
    You must attend and participate in the scheduled onboarding call with our team, during which we will configure and set up your Ad Tracking system.
  2. Complete All Four (4) Weekly Check-In Calls
    After onboarding, you must attend and participate in four mandatory check-in calls:
    • Week 1 Check-In
    • Week 2 Check-In
    • Week 3 Check-In
    • Week 4 Check-In
  3. Allow Our Team to Make Adjustments
    You must provide our team with the necessary access and cooperation to make any adjustments, configurations, or corrections to your tracking setup during the check-in period.
  4. Tracking System Failure After Full Support
    After completing the full onboarding process and all four check-in calls, if the tracking system fails to function as described in our product documentation, you may request a refund.

3.2 Attendance Requirements

"Attendance" means joining the scheduled call at the designated time and actively participating for the duration of the call. The following rules apply:

  • No-shows forfeit refund eligibility. Failure to attend any scheduled call without providing at least 24 hours' advance notice will result in immediate forfeiture of your refund eligibility.
  • Rescheduling. If you need to reschedule a call, you must notify our team at least 24 hours in advance. Rescheduled calls must occur within 48 hours of the original scheduled time.
  • Maximum one (1) reschedule per call. Each call may only be rescheduled once. A second reschedule request for the same call will forfeit your refund eligibility.
  • Late arrivals. Arriving more than 10 minutes late to a scheduled call without prior notice constitutes a no-show.

3.3 Refund Request Window

Timing Requirements

You must complete the full onboarding and support process (onboarding call + all four weekly check-ins) before you can request a refund.

After completing your Week 4 Check-In, you will have 5 business days to submit your refund request. Refund requests submitted after this 5-business-day window will not be honored.

Refund requests cannot be submitted until all check-in calls are completed. You must allow our team the full opportunity to configure and optimize your tracking before a refund can be considered. After the 5-business-day window following your Week 4 Check-In, no refunds will be issued under any circumstances.

4. Refund Eligibility Requirements (Ad Tracking 3-Month Prepay Only)

To summarize, you are only eligible for a refund if ALL of the following conditions are met. This applies exclusively to Ad Tracking 3-Month Prepay purchases. No other Cortana product qualifies for a refund.

  • 1.You purchased an Ad Tracking 3-Month Prepay plan specifically (not any other product)
  • 2.You completed the initial onboarding call
  • 3.You completed all four (4) weekly check-in calls (Week 1, 2, 3, and 4)
  • 4.You allowed our team to make all necessary adjustments to your tracking configuration
  • 5.The tracking system fails to function as described in product documentation after completing the full support process
  • 6.Your refund request is submitted within 5 business days after your Week 4 Check-In

4.1 What Does NOT Qualify for a Refund

The following situations do not qualify for a refund:

  • Any product other than Ad Tracking 3-Month Prepay - iMessage, phone calling, AI agents, AI usage, monthly subscriptions, etc.
  • Change of mind or buyer's remorse
  • Failure to attend onboarding or any check-in call
  • Failure to provide necessary access for our team to configure your tracking
  • Dissatisfaction unrelated to tracking functionality (e.g., business results, ad performance)
  • Inability or unwillingness to implement our team's recommendations
  • Requests submitted after the 5-business-day window has closed
  • Usage charges of any kind
  • Any other reason not explicitly covered by this policy

5. Refund Request Process

If you believe you meet all eligibility requirements, submit your refund request as follows:

  1. Email your request to hello@usecortana.ai with the subject line: "Refund Request - [Your Account Email]"
  2. Include in your email:
    • Your full name and account email address
    • Date of purchase
    • Confirmation that you completed all onboarding and check-in calls
    • Description of the tracking functionality issue
  3. Our team will review your request within 5 business days and verify that all eligibility requirements were met
  4. If approved, your refund will be processed to your original payment method within 10 business days

We reserve the right to deny any refund request that does not meet all eligibility requirements as determined by our records of your account activity and call attendance.

6. Chargeback Consequences

Warning: Filing a Chargeback Has Serious Consequences

You agreed to waive your chargeback rights as a condition of your purchase. Filing a chargeback in violation of this agreement will result in the following actions.

If you file a chargeback, dispute, or payment reversal in violation of this Refund Policy:

  • Immediate Account Termination: Your Cortana account will be immediately and permanently terminated, and you will lose access to all Services and data.
  • Chargeback Defense: We will vigorously contest any chargeback by providing your bank or payment processor with evidence of your agreement to this Refund Policy, including your acceptance of the chargeback waiver at checkout.
  • Collection Action: If the chargeback is successful, we reserve the right to pursue collection of the disputed amount plus any associated chargeback fees, administrative costs, and collection costs through a third-party collection agency or legal action.
  • Fraud Prevention Reporting: We may report your account information to chargeback prevention networks and fraud databases, which may affect your ability to make purchases with other merchants.
  • Legal Fees: You agree to reimburse Cortana for all reasonable legal fees and costs incurred in defending against or collecting on an improper chargeback.

Before filing a chargeback, please contact us at hello@usecortana.ai. We are committed to resolving legitimate billing issues directly and promptly.

7. All Other Products and Services

No Refunds - Final Sale

ALL CORTANA PRODUCTS AND SERVICES (EXCEPT AD TRACKING 3-MONTH PREPAY AS DESCRIBED IN SECTION 3) ARE NOT ELIGIBLE FOR REFUNDS UNDER ANY CIRCUMSTANCES.

This includes, without limitation:

  • Monthly subscriptions for any product (Ad Tracking, iMessage, etc.)
  • iMessage subscriptions and usage charges
  • Phone calling subscriptions and usage charges
  • AI calling agents subscriptions and usage charges
  • AI usage fees of any kind
  • Any usage-based charges incurred on your account
  • Any future products or features we may launch

By purchasing any of the above, you acknowledge and agree that:

  • All payments are final and non-refundable
  • There is no refund exception for these products and services
  • You may cancel subscriptions at any time, but no refunds or credits will be issued for the current billing period, any previous payments, or any usage charges incurred
  • Cancellation takes effect at the end of your current billing period
  • Usage charges are billed as incurred and are non-refundable regardless of cancellation

The only exception to this policy is the Ad Tracking 3-Month Prepay plan, which has a conditional refund option as described in Section 3. No other product or service qualifies for any refund under any circumstances.

8. Modifications to This Policy

We reserve the right to modify this Refund Policy at any time. Changes will take effect immediately upon posting. Your continued use of our Services after any changes constitutes acceptance of the updated policy.

The refund policy in effect at the time of your purchase will govern your refund rights for that specific purchase.
